FarmVille 2: Country Escape – 10th Anniversary Grand Prize Sweepstakes (“Sweepstakes”)

NO PURCHASE NECESSARY TO ENTER OR WIN.

ELIGIBILITY: OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES, DISTRICT OF COLUMBIA, AND CANADA (EXCLUDING QUEBEC) WHO ARE 18 OR OLDER (OR, IF HIGHER, THE AGE OF MAJORITY IN THE PLAYER’S COUNTRY OF RESIDENCE) AND HAVE A VALID FARMVILLE 2: COUNTRY ESCAPE ACCOUNT. VOID WHERE PROHIBITED. Employees (and their immediate families (spouse, and parents, children and siblings and their respective spouses, regardless of where they reside) and living in their same households, whether or not related) of Zynga Inc. (“Sponsor”), Take-Two Interactive Software, Inc., and their respective parents, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this Sweepstakes. Sweepstakes is subject to all applicable federal, state, provincial, national and local laws.

HOW TO ENTER:  On April 20, 2024, beginning at or around 12:00 AM Pacific Time (“PDT”),  and ending at 11:59 PM PDT on April 26, 2024 (the “Entry Period”), you can enter the Sweepstakes by engaging with the Anniversary Frenzy feature in FarmVille 2: Country Escape for seven (7) days in a row in order to collect a daily in-game reward (each, an “Entry”). Limit one (1) Entry per person. Multiple Entries from any person will be void.

DRAWINGS:  Potential winners will be selected in a random drawing held on or about May 6, 2024, from all eligible Entries received during the Entry Period. Odds of winning depend on the number of eligible Entries received during the Entry Period. Potential winners will be notified by an in-game pop-up. Potential winners may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within seven (7) days of date of issuance. A potential winner who is a Canadian resident must correctly answer, unaided, a time-limited mathematical skill-testing question as posed by Sponsor. If a potential winner does not respond to the initial notification within the time period stated, all required documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected for the drawing at issue. Only three (3) alternate potential winners will be selected for any prize, after which, such prize will not be awarded.

PrizeS (500): 500 winners shall receive a collection of FarmVille 2: Country Escape branded merchandise, including: water bottle, camper mug, journal and pen set, mobile phone grip, and plushie pig (“Prize”). Approximate Retail Value (“ARV”): $100 USD. Total ARV: $50,000 USD. Prizes will be delivered via US Mail or USPS International Shipping Services, as applicable.

Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All federal, state and local taxes, if any, and all other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winners. Winners may not substitute, assign or transfer prize, but Sponsor reserves the right, at its sole discretion, to substitute a prize of comparable or greater value. Prizes are not redeemable for cash. All prize details are at Sponsor’s sole discretion. Limit one (1) prize per person.

GRANT OF RIGHTS:  By submitting an Entry, to the extent permitted by law, each entrant hereby: (i) irrevocably and unconditionally waives, and agrees never to assert, any and all moral rights such entrant may have in and to their Entry; and (ii) grants to Sponsor and its licensees, successors and assigns an irrevocable, perpetual, unlimited, royalty-free, fully paid-up license to reproduce, distribute, display, exhibit, exploit, perform, edit, create derivatives of, and otherwise use the Entry and all elements of such Entry, together with any other material, and the name, user name, city and state of residence, voice, image and/or likeness of entrant (including, but not limited to, applicable profile photo), in any and all media now known or hereafter devised, in any manner, in whole or in part, worldwide, without compensation or notification to, or permission from, entrant or any third party, for any purpose whatsoever, including without limitation, for purposes of advertising or trade, except where prohibited by law.

GENERAL CONDITIONS: To the extent permitted by law, entrants, by participating, agree that Sponsor, Take-Two Interactive Software, Inc., and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including personal injury and/or death (other than in respect of any personal injury and/or death that is caused by Sponsor’s negligence), fraud, or any other liability that cannot be limited or excluded by applicable law, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a Prize or participation in this Sweepstakes. To the maximum extent permitted by law, in no event will the Released Parties be responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries, email, comments, @replies, messages, mail, or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer or other device related to or resulting from participating in this Sweepstakes or downloading materials from or use of the platform. Some jurisdictions may not allow limitations or exclusions of liability for certain categories of loss or damage, so some of the above limitations or exclusions may not apply to all entrants or shall only apply to the maximum extent permitted by applicable law. In the event that any of the above limitations or exclusions of liability are not enforceable under applicable law, the affected limitation or exclusion of liability shall be deemed omitted from these Official Rules and shall in no way affect the legality, validity or enforceability of the remainder of these Official Rules.

Persons who tamper with or abuse any aspect of the Sweepstakes or platform or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor.

The above provisions apply to the fullest extent permissible by law, save that, to the extent an Eligible Country’s law applies, nothing in these Official Rules shall exclude or limit the Sponsor’s or Released Parties’ liability for: (i) fraud or fraudulent misrepresentation; (ii) death or personal injury caused by such party’s negligence; or (iii) any other type of liability which may not be lawfully excluded or limited.

DISPUTES; GOVERNING LAW: THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. Entrants resident in the United States of America hereby waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association and hereby agree that any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of New York, City of New York.

For entrants who are not resident in the United States of America and/or for any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the County of New York in the State of New York.  The parties agree not to raise the defense of forum non conveniens.

USE OF DATA:  Any personal data submitted to, or collected by, Sponsor in connection with the Sweepstakes, will be processed by Sponsor and/or its data processors in accordance with its privacy policy for the sole purposes of conducting, administering and marketing the Sweepstakes. Please review the Sponsor’s privacy policy located at www.take2games.com/privacy. Any personal data submitted to, or collected by, Sponsor or its data processors in connection with the Sweepstakes will be processed by Sponsor and/or its data processors in accordance with Sponsor’s privacy policy for the purposes of conducting, administering, and marketing the Sweepstakes. By participating in the Sweepstakes, entrants hereby acknowledge that: (i) they have read and understood Sponsor’s privacy policy; (ii) Sponsor has a valid legitimate interest in processing their personal data for these purposes; and (iii) Sponsor’s legitimate interests are not outweighed by their own interests or fundamental rights and freedoms.

 WINNERS LIST: To receive the names of the winners, send a request via (as applicable) Zynga Customer Service, for receipt no later than thirty (30) days after the end of the Sweepstakes.
