FarmVille 2: Country Escape – 10th Anniversary Grand Prize Challenge (“Challenge”)

NO PURCHASE NECESSARY TO ENTER OR WIN.

ELIGIBILITY: OPEN TO INDIVIDUAL PLAYERS WHO HAVE A VALID ACCOUNT FOR FARMVILLE 2: COUNTRY ESCAPE AND ARE 18 YEARS OF AGE OR OLDER (OR, IF HIGHER, THE AGE OF MAJORITY IN THE PLAYER’S COUNTRY OF RESIDENCE), EXCLUDING PLAYERS IN THE UNITED STATES AND CANADA. VOID WHERE PROHIBITED. Employees (and their immediate families (spouse, and parents, children and siblings and their respective spouses, regardless of where they reside) and living in their same households, whether or not related) of Zynga Inc. (“Sponsor”), Take-Two Interactive Software, Inc., and their respective parents, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this Challenge. Challenge is subject to all applicable federal, state, provincial, national and local laws.

HOW TO ENTER:  On April 20, 2024, beginning at or around 12:00 AM Pacific Time (“PDT”) / 8:00 AM British Summer Time (“BST”) / 9:00 AM Central European Summer Time (“CEST”),  and ending at 11:59 PM PDT / 7:59 AM BST / 8:59 AM CEST, on April 26, 2024 (the “Entry Period”), you can enter the Challenge by engaging with the Anniversary Frenzy feature in FarmVille 2: Country Escape for seven (7) days in a row in order to collect a daily in-game reward (each, an “Entry”). Limit one (1) Entry per person. Multiple Entries from any person will be void.

DRAWINGS:  Potential winners will be selected in a random drawing held on or about May 6, 2024 from all eligible Entries received during the Entry Period. Odds of winning depend on the number of eligible Entries received during the Entry Period. Potential winners will be notified by an in-game pop-up. If a potential winner does not respond to the initial notification within the time period stated, a prize or prize notification is returned as undeliverable, or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected for the drawing at issue. Only three (3) alternate potential winners will be selected for any prize, after which, such prize will not be awarded.

PrizeS (500): 500 Winners shall receive an in-game FarmVille 2: Country Escape prize of a uniquely decorated cow, that can be harvested for two milks at a time instead of the usual one (“Prize”). For the avoidance of doubt, the Prize is an in-game virtual good which: (i) has no monetary value; (ii) must not be used outside of the FarmVille 2: Country Escape; and (iii) must only be used in accordance with Sponsor’s Terms of Service, located at https://www.take2games.com/legal/en-US. Prize will be electronically delivered to winner in-game via an in-game popup.

Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All federal, state and local taxes, if any, and all other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winners. Winners may not substitute, assign or transfer prize, but Sponsor reserves the right, at its sole discretion, to substitute a prize of comparable or greater value. Prizes are not redeemable for cash. All prize details are at Sponsor’s sole discretion. Limit one (1) prize per person.

GRANT OF RIGHTS:  By submitting an Entry, to the extent permitted by law, each entrant hereby: (i) irrevocably and unconditionally waives, and agrees never to assert, any and all moral rights such entrant may have in and to their Entry; and (ii) grants to Sponsor and its licensees, successors and assigns an irrevocable, perpetual, unlimited, royalty-free, fully paid-up license to reproduce, distribute, display, exhibit, exploit, perform, edit, create derivatives of, and otherwise use the Entry and all elements of such Entry, together with any other material, and the name, user name, city and state of residence, voice, image and/or likeness of entrant (including, but not limited to, applicable profile photo), in any and all media now known or hereafter devised, in any manner, in whole or in part, worldwide, without compensation or notification to, or permission from, entrant or any third party, for any purpose whatsoever, including without limitation, for purposes of advertising or trade, except where prohibited by law.

GENERAL CONDITIONS: To the extent permitted by law, entrants, by participating, agree that Sponsor, Take-Two Interactive Software, Inc., and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including personal injury and/or death (other than in respect of any personal injury and/or death that is caused by Sponsor’s negligence), fraud, or any other liability that cannot be limited or excluded by applicable law, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a Prize or participation in this Challenge. To the maximum extent permitted by law, in no event will the Released Parties be responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries, email, comments, @replies, messages, mail, or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Challenge, including, without limitation, errors or difficulties which may occur in connection with the administration of the Challenge, the processing of entries, the announcement of the prizes or in any Challenge-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Challenge. Released Parties are not responsible for injury or damage to participants' or to any other person's computer or other device related to or resulting from participating in this Challenge or downloading materials from or use of the platform. Some jurisdictions may not allow limitations or exclusions of liability for certain categories of loss or damage, so some of the above limitations or exclusions may not apply to all entrants or shall only apply to the maximum extent permitted by applicable law. In the event that any of the above limitations or exclusions of liability are not enforceable under applicable law, the affected limitation or exclusion of liability shall be deemed omitted from these Official Rules and shall in no way affect the legality, validity or enforceability of the remainder of these Official Rules.

Persons who tamper with or abuse any aspect of the Challenge or platform or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Challenge be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Challenge and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor.

The above provisions apply to the fullest extent permissible by law, save that, to the extent an Eligible Country’s law applies, nothing in these Official Rules shall exclude or limit the Sponsor’s or Released Parties’ liability for: (i) fraud or fraudulent misrepresentation; (ii) death or personal injury caused by such party’s negligence; or (iii) any other type of liability which may not be lawfully excluded or limited.

DISPUTES; GOVERNING LAW: THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. Entrants resident in the United States of America hereby waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Challenge. Any controversy or claim arising out of or relating to these Official Rules and/or the Challenge shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association and hereby agree that any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of New York, City of New York.

For entrants who are not resident in the United States of America and/or for any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Challenge, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the County of New York in the State of New York.  The parties agree not to raise the defense of forum non conveniens.

USE OF DATA:  Any personal data submitted to, or collected by, Sponsor in connection with the Challenge, will be processed by Sponsor and/or its data processors in accordance with its privacy policy for the sole purposes of conducting, administering and marketing the Challenge. Please review the Sponsor’s privacy policy located at www.take2games.com/privacy. Any personal data submitted to, or collected by, Sponsor or its data processors in connection with the Challenge will be processed by Sponsor and/or its data processors in accordance with Sponsor’s privacy policy for the purposes of conducting, administering, and marketing the Challenge. By participating in the Challenge, entrants hereby acknowledge that: (i) they have read and understood Sponsor’s privacy policy; (ii) Sponsor has a valid legitimate interest in processing their personal data for these purposes; and (iii) Sponsor’s legitimate interests are not outweighed by their own interests or fundamental rights and freedoms.

WINNERS LIST: To receive the names of the winners, send a request via (as applicable) Zynga Customer Service, for receipt no later than thirty (30) days after the end of the Challenge. Any United Kingdom entrant may request that the amount of information about them published in the way described above be reduced, by contacting the Sponsor via the FarmVille 2: Country Escape Contact Us form (https://zyngasupport.helpshift.com/hc/en/11-farmville-2-country-escape/contact-us/). In these circumstances, the entrant acknowledges that the Sponsor may nevertheless disclose the relevant information, and the entrant’s Entry, to the United Kingdom’s Advertising Standards Authority (and/or any other competent authority) if required to do so. By way of example, this may happen if the Sponsor is required to demonstrate that it has awarded any advertised prizes.
