ZYNGA CHALLENGE OFFICIAL RULES
No Purchase Necessary To Enter or Win
These Official Rules apply to certain challenges conducted by Zynga Inc. (“Zynga”). Each individual challenge will be announced in-game via a pop-up post or other in-game announcement, or via email (“Challenge Posting”). A Challenge Posting will include the event date, end date and time, how to participate, and the prize(s). All information contained in a Challenge Posting is incorporated herein by reference.
ELIGIBILITY: UNLESS OTHERWISE STATED IN THE CHALLENGE POSTING, CHALLENGES ARE OPEN TO INDIVIDUAL PLAYERS WHO HAVE A VALID ACCOUNT FOR THE APPLICABLE ZYNGA GAME. Void Where Prohibited. An eligible minor MUST have a parent’s or legal GUARDIAN’S permission to participate. By participating, players (and, if an eligible minor, their parent or legal guardian) agree to be bound by these Official Rules and all applicable game rules and regulations and the decisions of the judges and/or Zynga, which are binding and final on all matters relating to this Challenge. Challenge is subject to all applicable federal, provincial, state and local laws.
HOW TO ENTER: To enter, follow the directions provided in the Challenge Posting during the period specified in the Challenge Posting (“Entry Period”). The Challenge must be completed during the Entry Period to be eligible. Limit one (1) entry per player per Challenge, unless otherwise stated in the Challenge Posting. Entries received from any player in excess of the stated limitation or after the Entry Period will be void. Zynga may prohibit any player from participating in a Challenge or receiving any prize if, in its sole discretion, it determines that such player has attempted to undermine the legitimate operation of the Challenge by cheating, hacking, unfair playing practices, the use of any script, macro or other automated means of entry or if such player has otherwise violated Zynga’s Terms of Service.
WINNER DETERMINATION: Potential winner(s) will be determined as set forth in the Challenge Posting from all eligible entries received during the Entry Period. In the event of a tie, the first player who obtained the best time/score from among those tied will be determined the potential winner. Potential winner(s) will be notified in-game and may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within seven (7) days of date of issuance. If such documents are not returned within the specified time period, the prize notification is returned as undeliverable, or a potential winner is not in compliance with these Official Rules, the prize will be forfeited and, at Zynga’s discretion, an alternate winner from the remaining pool of eligible qualifying players may be selected using the same winner selection method.
PRIZE(S): The prize(s) will be set forth in the Challenge Posting. Prizes have no cash value and no value (retail or otherwise), outside of the applicable Zynga game. Prizes awarded in connection with a Challenge will be granted directly to each winner’s player account for the relevant game. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Prizes may not be substituted, assigned or transferred or redeemed for cash, however Zynga reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with a comparable or better prize. Winners are responsible for any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion. Limit one (1) prize per player per Challenge unless otherwise stated in the Challenge Posting.
PUBLICITY GRANT: Each winner (and, if an eligible minor, their parent or legal guardian), by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, avatar/user name and likeness, social handle/username and profile picture, address (city and state), and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval.
GENERAL CONDITIONS: To the maximum extent permitted by law, by participating in any Challenge, players (and, if an eligible minor, their parent or legal guardian) agree that Zynga and Zynga’s respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by players against, any liability, for any injuries, losses or damages of any kind, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Challenge.
FOR PLAYERS WHO ARE RESIDENTS OF THE UNITED KINGDOM OR AN EU MEMBER STATE, THEN NOTWITHSTANDING ANYTHING TO THE CONTRARY SET OUT ABOVE: (I) THE RELEASED PARTIES SHALL BE RESPONSIBLE FOR ANY LOSS OR DAMAGE TO THE PLAYER’S DEVICE USED TO PLAY THE ZYNGA GAME THAT IS A REASONABLY FORESEEABLE RESULT OF ZYNGA'S BREACH OF THESE OFFICIAL RULES, ITS NEGLIGENCE, OR THE PLAYER’S RECEIPT OF ANY PRIZE; (II) SAVE AS EXPRESSLY SET OUT HEREIN, THE RELEASED PARTIES’ MAXIMUM LIABILITY UNDER THESE OFFICIAL RULES SHALL NOT EXCEED THE PRICE PAID BY THE RELEVANT PLAYER TO PURCHASE THE GAME; AND (III) NOTHING IN THESE OFFICIAL RULES SHALL AFFECT THE RELEASED PARTIES’ LIABILITY FOR DEATH OR PERSONAL INJURY ARISING FROM ITS NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
The Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered or garbled entries, in-game messages or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Challenge, including, without limitation, errors or difficulties which may occur in connection with the administration of the Challenge, the processing of entries, the announcement of the prize(s) or in any Challenge-related materials. The Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by players, tampering, hacking, or by any equipment or programming associated with or utilized in the Challenge. Save as set out in these Official Rules, Released Parties are not responsible for injury or damage to participants' or to any other player's computer or other device related to or resulting from participating in this Challenge. Players who tamper with or abuse any aspect of the Challenge, the Game or any associated website or who are in violation of these Official Rules, as solely determined by Zynga, will be disqualified and all associated entries will be void. Zynga reserves the right to suspend, modify or terminate the Challenge at any time and for any reason, including, but not limited to, if any portion of the Challenge is, in Zynga’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of Zynga, corrupt or impair the administration, security, fairness or proper play of, or participation in, the Challenge. If Zynga terminates any Challenge, Zynga may, at its sole discretion, either withhold the Challenge’s prize(s) or award such prize(s) using the winner selection criteria described in the Challenge Posting to any of the eligible players who successfully completed the Challenge prior to it being terminated or as otherwise deemed fair and appropriate by Zynga.
