Zynga’s Iron Throne House Challenge

NO PURCHASE NECESSARY TO ENTER OR WIN.

ElIGIBILITY: Open BY INVITATION Only to LEGAL RESIDENTS OF THE TERRITORIES IN WHICH THIS CHALLENGE IS RUN WHO ARE 18 OR OLDER, HAVE A VALID Game of Thrones Slots ACCOUNT (The “Game”), AND ARE MEMBERS OF A HOUSE WITHIN THE IRON THRONE DIVISION OF THE GAME THROUGHOUT THE CHALLENGE PERIOD. Void Where Prohibited. Employees and their immediate families (parents, children, spouse, or siblings, and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, of Zynga, Inc. (“Sponsor”), Take-Two Interactive Software, Inc., Home Box Office, Inc., and their respective parents, subsidiaries, divisions, affiliated companies, and advertising and promotion agencies are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules, the Zynga Terms of Service (https://www.zynga.com/legal/terms-of-service), and the decisions of the Sponsor, which are binding and final on matters relating to this Challenge. Challenge is subject to all applicable federal, provincial, state and local laws.

CHALLENGE PERIOD: Zynga’s Iron Throne House Challenge (“Challenge”) begins at 10:00 AM Pacific Time (“PT”) on October 29, 2024 and ends at 9:00 AM PT on November 5, 2024 (“Challenge Period”).

TO ENTER: Eligible players can enter the Challenge during the Challenge Period by earning House Points for their house.

Players earn House Points through the following methods:

1. Every 10K coins won from spinning in a machine is one (1) House Point; and
2. Placing in the top 3 on the leaderboard in the “Control the Keeps” machines earns House Points, as outlined below for the Iron Throne Division.

WINNER DETERMINATION: At the close of the Challenge Period, the house with the most House Points in the Iron Throne Division of the Game will be declared the winning house (“Winning House”), and each eligible player in the Winning House will be declared a winner (“Winner” and together “Winners”). The Winning House may consist of up to 25 Winners.

WINNER NOTIFICATION: Each Winner will be notified by in-game messaging, and/or via email if Sponsor has previously obtained Winner’s email address, and may be required to execute and return a Declaration of Eligibility, Liability, W-9 Form, and, unless prohibited, Publicity Release within five (5) days of notification. If a Winner is unable to be contacted or fails to respond within two (2) days of date of notification, does not return all required documentation within the time period stated, or if a prize notification or prize is returned as undeliverable, or a Winner is not in compliance with these rules, applicable prize will be forfeited.

PRIZES: Each Winner will receive one (1) travel tumbler with engraved Game of Thrones Slots branding (“Prize”). Approximate Retail Value (“ARV”) is $50.

Total ARV of Prizes is $1,250 USD.

Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All federal, state, and local taxes (including income and withholding taxes), if any, and all other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winners. Winners may not substitute, assign or transfer prize, but Sponsor reserves the right, at its sole discretion, to substitute a prize of comparable or greater value. All prize details are at Sponsor’s sole discretion. Limit one (1) prize per authorized account and household.

The Released Parties (as defined below) are not responsible for and will not replace any lost, mutilated, or stolen prize(s) or any prize that is undeliverable or does not reach a winner because of an incorrect or changed address. Prizes will be sent to Winners via mail.

PUBLICITY GRANT: The winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state/province), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, in any manner, worldwide in perpetuity, without notice or review or approval.

GENERAL CONDITIONS: To the extent permitted by law, entrants, by participating, agree that Sponsor, Take-Two Interactive Software, Inc., Home Box Office, Inc., and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including personal injury and/or death (other than in respect of any personal injury and/or death that is caused by Sponsor’s negligence), fraud, or any other liability that cannot be limited or excluded by applicable law, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a Prize or participation in this Sweepstakes. To the maximum extent permitted by law, in no event will the Released Parties be responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries, email, comments, @replies, messages, mail, or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer or other device related to or resulting from participating in this Sweepstakes or downloading materials from or use of the platform. Some jurisdictions may not allow limitations or exclusions of liability for certain categories of loss or damage, so some of the above limitations or exclusions may not apply to all entrants or shall only apply to the maximum extent permitted by applicable law. In the event that any of the above limitations or exclusions of liability are not enforceable under applicable law, the affected limitation or exclusion of liability shall be deemed omitted from these Official Rules and shall in no way affect the legality, validity or enforceability of the remainder of these Official Rules.

Persons who tamper with or abuse any aspect of the Sweepstakes or platform or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winners for the Entry Method(s) at issue from all eligible, non-suspect entries received for such Entry Method(s) prior to action taken or as otherwise deemed fair and appropriate by Sponsor.

The above provisions apply to the fullest extent permissible by law, save that, to the extent an Eligible Country’s law applies, nothing in these Official Rules shall exclude or limit the Sponsor’s or Released Parties’ liability for: (i) fraud or fraudulent misrepresentation; (ii) death or personal injury caused by such party’s negligence; or (iii) any other type of liability which may not be lawfully excluded or limited.

DISPUTES; GOVERNING LAW: THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. Entrants resident in the United States of America hereby waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association and hereby agree that any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of New York, City of New York.

For entrants who are not resident in the United States of America and/or for any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the County of New York in the State of New York.  The parties agree not to raise the defense of forum non conveniens.

USE OF DATA:  Any personal data submitted to, or collected by, Sponsor in connection with the Sweepstakes, will be processed by Sponsor and/or its data processors in accordance with its privacy policy or the sole purposes of conducting, administering and marketing the Sweepstakes. Please review the Sponsor’s privacy policy at https://www.take2games.com/privacy.  Any personal data submitted to, or collected by, Sponsor or its data processors in connection with the Sweepstakes will be processed by Sponsor and/or its data processors in accordance with Sponsor’s privacy policy for the purposes of conducting, administering, and marketing the Sweepstakes. By participating in the sweepstakes, entrants hereby acknowledge that: (i) they have read and understood Sponsor’s privacy policy; (ii) Sponsor has a valid legitimate interest in processing their personal data for these purposes; and (iii) Sponsor’s legitimate interests are not outweighed by their own interests or fundamental rights and freedoms.

WINNERS LIST: To receive the names of the winners (first name, last initial and state/province of residence), email viprequest@zynga.com with “Zynga’s Iron Throne House Challenge” in the subject line, no later than 90 (ninety) days after the end of the Challenge Period. Any United Kingdom entrant may request that the amount of information about them published in the way described above be reduced, by contacting the Sponsor using the contact details above. In these circumstances, the entrant acknowledges that the Sponsor may nevertheless disclose the relevant information, and the entrant’s Entries, to the United Kingdom’s Advertising Standards Authority (and/or any other competent authority) if required to do so. By way of example, this may happen if the Sponsor is required to demonstrate that it has awarded any advertised prizes.
