FarmVille 3 - Spooky Autumn Decoration Contest

 

Official Rules

 

NO PURCHASE NECESSARY TO ENTER OR WIN.

 

 

ELIGIBILITY: Participation open only to legal residents of the fifty United States and the District of Columbia who are at least 18 years old as of date of entry, have a valid FarmVille 3 account, and who are the direct and intended recipients of an email invitation to enter the Contest (the email invitation shall be referred to as “Email Invitation”, and the recipients of the Email Invitation shall collectively be referred to as “FarmVille 3 VIPs”). Void where prohibited by law.  Employees of Zynga, Inc. ("Sponsor"), Take-Two Interactive Software, Inc., and their respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Contest is subject to all applicable federal, state and local laws. By participating, each entrant agrees to abide by these Official Rules and decisions of the Judging Panel, which shall be final and binding in all respects relating to this Contest.

CONTEST PERIOD: FarmVille 3 - Spooky Autumn Decoration Contest ("Contest") starts on October 16, 2023 at 12:00 AM Pacific Time (“PT”) and ends on October 19, 2023 at 11:59 PM PT ("Contest Period"). Sponsor’s computer is the official time-keeping device for the Contest. 

HOW TO ENTER:  Eligible players can enter during the Contest Period by replying to the Email Invitation using the email address which has received such Email Invitation with a photo of their autumn, seasonal, and/or Halloween decorations outside of the FarmVille 3 game and their Player ID. All entry information and other content submitted by an entrant as part of this Contest shall be collectively referred to herein as the “Submissions” or each as a “Submission.” All Submissions must comply with the Guidelines and Restrictions (as defined below), as determined by Sponsor in its sole and absolute discretion.  Sponsor reserves the right to cancel or modify this Contest in the event an insufficient number of Submissions are received that meet the minimum judging criteria. 

 

Limit one (1) Submission per person for the entire Contest Period. All Submissions must be received by October 19, 2023 at 11:59 PM PT. Submissions generated by script, macro or other automated means or by any means which subvert the entry process are void. Multiple Submissions from any person will be void. All Submissions become the property of Sponsor.

 

SUBMISSION GUIDELINES AND CONTENT RESTRICTIONS: By entering the Contest, each entrant agrees that their Submission conforms to the Submission Guidelines and Content Restrictions as defined below (collectively, the “Guidelines and Restrictions”) and that Sponsor, in its sole discretion, may remove any Submission and disqualify an entrant from the Contest if it believes, in its sole discretion, that the entrant’s Submission fails to conform to the Guidelines and Restrictions. 

 

         Submission Guidelines:

  • All Submissions must be submitted in one of the following image formats: .jpg, .gif, or .png.
  • All Submissions must be 3MB or smaller.
  • The Submission cannot have been submitted previously in a promotion of any kind, won any award or been exhibited or displayed publicly through any means.

 

         Content Restrictions:

Submissions may not contain, as determined by the Sponsor, in its sole discretion, any content that:

 

  • is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
  • is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Submissions;
  • defames, misrepresents or contains disparaging remarks about other people or companies;
  • contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
  • contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;
  • contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
  • contains look-alikes of celebrities or other public or private figures, living or dead;
  • communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or
  • violates any law.

Entrants acknowledge that other entrants may have used ideas and/or concepts in their Submission that may have similarities to ideas or concepts included in entrant’s Submission, and entrants understand and agree that they shall not in any way be entitled to any compensation because of any such similarities.  Sponsor’s decisions are final and binding in all matters relating to this Contest, including interpretation and application of these Official Rules.

PUBLICITY GRANT AND LICENSE/USE OF SUBMISSIONS: By submitting a Submission, each entrant hereby: (i) irrevocably and unconditionally waives, and agrees to never assert, any and all moral rights such entrant may have in and to the Submission; and (ii) grants to Sponsor and its licensees, successors and assigns an irrevocable, perpetual, unlimited, royalty-free, fully paid-up license to reproduce, distribute, display, exhibit, exploit, perform, edit, create derivatives of, and otherwise use the Submission and all elements of such Submission, together with any other material, and the name, user name, city and state of residence, voice, image and/or likeness of entrant (including, but not limited to, profile photo), in any and all media now known or hereafter devised, in any manner, in whole or in part, worldwide, without compensation or notification to, or permission from, entrant or any third party, for any purpose whatsoever, including without limitation, for purposes of advertising or trade. Entrant agrees that, if required by Sponsor, they will sign documents to this effect. Released Parties (as defined below) are not responsible for any unauthorized use of Submissions by third parties. Sponsor has no obligation to make use of the rights granted herein.

 

INDEPENDENTLY DEVELOPED SUBMISSIONS: Each entrant understands and agrees that Sponsor’s use in matters independently developed of material similar to or identical with the Submission or containing features or elements similar to or identical with those contained in the Submission will not obligate Sponsor to negotiate with entrant, nor will it entitle entrant to any compensation of any kind.  Each entrant agrees and acknowledges that nothing herein shall preclude Sponsor from using any material in or similar to the Submission without obligation to entrant, including, but not limited to, if Sponsor has or has determined that it has an independent legal right to use such other material, including without limitation, because such features or elements were not new or novel, or were not originated by entrant, or were or may hereafter be independently created by or submitted to Sponsor.

 

FINALIST ROUND/JUDGING PANEL: This Contest is a game of skill and chance plays no part in the determination of the Finalists nor the Winner. On or about October 20, 2023, Sponsor together with an independent judge determined by Sponsor in its sole and absolute discretion (collectively, the “Judging Panel”), shall review all eligible Submissions, and Sponsor will select three (3) finalists (collectively, the “Finalists”, and individually a “Finalist”). The Judging Panel will judge the Submissions and select the Finalists based on the following equally-weighted judging criteria (“Judging Panel Criteria”): (a) creativity; and (b) alignment with theme. On or about October 23, 2023, Sponsor will announce the Finalists to the FarmVille 3 VIPs via email (“Finalists Announcement Email”), where the Finalists will be entered into the final round of the Contest for a vote among all FarmVille 3 VIPs who will determine the final winner (“Winner”). Subject to verification and compliance with these Official Rules, the Submission which receives the most votes from the FarmVille 3 VIPs shall be designated as the Winner.  In the event of a tie, all tied Submissions will be re-judged by an additional judge selected by Sponsor who will break the tie using the Judging Panel Criteria.  By entering the Contest, entrants fully and unconditionally agree to be bound by these rules and the decisions of the Judging Panel, which will be final and binding in all matters relating to the Contest.

VOTING PERIOD AND WINNER DETERMINATION: All Finalists will be judged by FarmVille 3 VIPs during the voting period (“Voting Period”), which begins following the Finalists Announcement Email on October 23, 2023 and ends at October 26, 2023 11:59 PM PT. During the Voting Period, the Finalists’ Submissions will be judged by FarmVille 3 VIPS, who will vote on which one (1) of the Finalists’ Submissions is the best overall Submission.  To vote for their favorite Submission, FarmVille 3 VIPs must reply to the Finalist Announcement Email with their vote. FarmVille 3 VIPs may only vote for one (1) Submission, and may only vote one (1) time during the Voting Period.   The Submission receiving the highest number of votes during the Voting Period will be designated as the potential Winner, subject to verification, including ensuring compliance with these Official Rules and the Guidelines and Restrictions included herein, as determined by Sponsor in its sole and absolute discretion.

Limit one (1) vote per FarmVille 3 VIP throughout the Voting Period. Any attempt by any voter to submit more than the stated number of votes will void that voter’s votes. The use of robotic or automatic devices for voting is prohibited and Sponsor reserves the right to nullify any and all such votes and to disqualify from voting the responsible individual.  Finalists are prohibited from obtaining votes by any fraudulent or inappropriate means, including offering prizes or other inducements to members of public, as determined by Sponsor, in its sole discretion and Sponsor reserves the right to nullify any and all such votes and to disqualify from Contest the responsible Finalist.  Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected votes, which will be void.  Only valid votes received by Sponsor during the Voting Period will count towards a Finalist’s final score.

 

WINNER NOTIFICATION: The potential Winner will be notified by telephone on or about October 27, 2023 and may be required to execute and return a Declaration of Eligibility, Liability and, unless prohibited, Publicity Release. In the event: (i) the Winner cannot be contacted within three (3) calendar days of first notification attempt; (ii) any Prize or Prize notification is returned as undeliverable; (iii) the Winner rejects their Prize; or (iv) in the event of noncompliance with these Official Rules and the Guidelines and Restrictions, such Prize will be forfeited and may be awarded to the Submission with the next highest score. Upon Prize forfeiture, no Prize will be given. Prize will be electronically delivered to the Recipients (as defined below) at the email address provided at time of winner confirmation.

 

PRIZES: The Prize will be rewarded as follows (each recipient of the applicable Prize shall be referred to as “Recipient” and together as the “Recipients”): (i) all eligible players that make an eligible Submission during the Contest Period, except for the Finalists and Winner, will each receive 100 gems; (2) Finalists will receive 500 gems. The Winner with the most votes during the Voting Period will receive 1000 gems (collectively and individually referred to as “Prize”). For the avoidance of doubt, the Prize is an in-game virtual good which: (i) has no monetary value; (ii) must not be used outside of FarmVille 3; and (iii) must only be used in accordance with Sponsor’s Terms of Service, located at https://www.zynga.com/legal/terms-of-service. Prizes are awarded “as-is” with no warranty or guarantee, either express or implied. All federal, state, and local taxes, if any, and all other costs and expenses associated with acceptance of the Prize and use not specified herein as being provided are the sole responsibility of the Winner. The Winner may not substitute, assign or transfer Prize, but Sponsor reserves the right, at its sole discretion, to substitute the prize or any part of the Prize of comparable or greater value. The Prizes is not redeemable for cash. All prize details are at Sponsor’s sole discretion. Limit one (1) prize per person and per household.

 

ALL ENTRANTS ACKNOWLEDGE AND AGREE THAT SPONSOR SHALL HAVE NO OBLIGATION TO POST, DISPLAY, OR OTHERWISE USE ANY SUBMISSIONS, INCLUDING WITHOUT LIMITATION THE WINNING SUBMISSION(S).  FOR SAKE OF CLARITY, ENTRANTS UNDERSTAND AND AGREE THAT EVEN IF ENTRANT IS A WINNING SUBMISSION SPONSOR IS UNDER NO OBLIGATION TO USE THE WINNING SUBMISSION FOR ANY PURPOSE WHATSOEVER.  HOWEVER, SPONSOR WILL HAVE THE RIGHT, BUT NOT THE OBLIGATION, AS DETERMINED BY IT IN ITS SOLE AND ABSOLUTE DISCRETION, TO USE THE WINNING SUBMISSION.  IF ANY SUBMISSION IS USED BY SPONSOR, INCLUDING THE WINNING SUBMISSIONS, ENTRANTS WILL NOT RECEIVE ANY COMMISSION ON ANY PRODUCTS OR MERCHANDISE WITH SUCH ENTRANT’S SUBMISSION (IF APPLICABLE). 

 

GENERAL CONDITIONS: By participating, each entrant agrees to release, discharge and hold harmless Sponsor, Take-Two Interactive Software, Inc., and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including personal injury and/or death (other than in respect of any personal injury and/or death that is caused by Sponsor’s negligence, fraud, or any other liability that cannot be limited or excluded by applicable law), or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of any awarded Prize (including any travel or activity related thereto).

 

To the maximum extent permitted by law, in no event will the Released Parties be responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled Submissions, emails, phone calls, or communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of the Submissions, the announcement of the Prize or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Submissions will be void. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of the Submissions, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the Winner from all eligible, non-suspect Submissions received prior to action taken using the winner determination procedure outlined above or as otherwise deemed fair and appropriate by Sponsor. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

 

DISPUTES; GOVERNING LAW: THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. Entrants resident in the United States of America hereby waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Contest. Any controversy or claim arising out of or relating to these Official Rules and/or the Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association and hereby agree that any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of New York, City of New York.

 

USE OF DATA: All personal data submitted to, or collected by, Sponsor in connection with the Contest, will be processed by Sponsor and/or its data processors in accordance with its privacy policy for the sole purposes of conducting, administering and marketing the Contest. Please review the Sponsor’s privacy policy at www.take2games.com/privacy. By participating in the Contest, entrants hereby acknowledge that: (i) they have read and accepted the Sponsor’s privacy policy; (ii) Sponsor has a valid and legitimate interest in processing their personal data for these purposes; and (iii) Sponsor’s legitimate interests are not outweighed by their own interests or fundamental rights and freedoms.

 

WINNER ANNOUNCEMENT: The email announcing the Winner (“Winner Announcement Email”) will be sent to all FarmVille 3 VIPs by Sponsor following the Winner determination on or about October 31, 2023.
